Alex Kriegsman

Alex Kriegsman has a diverse litigation practice, representing clients in a broad range of matters in federal and state courts.  He has extensive experience in construction litigation, successfully representing developers, home owners, and builders in fraud and breach of contract suits.  Alex also has a remarkable record of success in litigating Article 78 proceedings against municipalities who have denied his clients’ development applications. 

Previously, Alex was an Assistant United States Attorney for over 5 years, where he successfully tried civil and criminal cases in federal court.  He was given numerous awards and commendations for his work on several high-profile health care fraud cases involving settlements in the hundreds of millions of dollars.

After clerking for federal district court and state supreme court judges, Alex began his career at Skadden, Arps, where he spent several years working on major commercial litigation. He also served as a trial attorney for the Department of Justice in Washington, DC, handling environmental, land use and natural resources litigation.

Alex has taught lawyering skills and legal writing classes as an Adjunct Professor of Law at George Washington University and Cardozo Law School.

 
 

Representative Matters

  • Represent developer of waterfront estate in suit against builder for breach of contract and fraud, obtain TRO enforcing builder's termination and banning him from the property, successfully obtain return of developer's capital and summary judgment order for breach of fiduciary duty

  • Represent homeowner in fraud and breach of contract suit against builder and real estate agent in federal court, successfully defend lis pendens placed on builder and developer properties, obtain large settlement award for client

  • Successfully represent homeowner who was denied a variance for a swimming pool in Article 78 proceeding against zoning board, obtaining order directing municipality to issue pool permit

  • Successfully represent developer whose application to develop historic property was denied by architectural review board in Article 78 proceeding against village, obtaining court order directing village to issue building permit as requested by developer

  • Successfully represent stockholder representative in earnout suit against former company and private equity firm in Delaware Chancery Court, obtaining favorable settlement

  • Successfully represent former CEO of data company in defending against suit filed by former company for breach of contract, obtaining dismissal

  • Represent seller of multi-million dollar properties in brokerage commission dispute with real estate agency, successfully oppose summary judgment motion in state supreme court, successful representation on appeal to Second Department where summary judgment decision is affirmed

  • Successfully represent builder in defending against lawsuit from former employer asserting breach of fiduciary duty and faithless servant claims, obtain settlement for small fraction of damages alleged

  • Successfully represent several homeowners in lawsuits against municipality challenging moratorium on development, obtain order declaring moratorium inapplicable to our clients

  • Represent homeowner in Article 78 proceeding against municipality in state supreme court, obtain TRO against enforcement of local zoning code


Honors and Awards

  • Special Commendation from the United States Attorney’s Office for the Maxim Healthcare Services global settlement, which involved a $150 million settlement and deferred prosecution agreement.

  • Special Commendation from the United States Attorney’s Office for the McKesson AWP Settlement, which involved a $190 million recovery for the United States.

  • Distinguished Service Award from the U.S. Department of Health and Human Services for the UMDNJ cardiology case, which involved 12 civil settlement agreements totaling over $13 million, three guilty pleas, a corporate integrity agreement, and false claims act trial against a doctor, which Alex led.

  • Distinguished Service Award from the U.S. Department of Agriculture for successfully defending the United States in a 6-week jury trial in an employment discrimination case.
